Sexual Misconduct

How do I file a charge?

When a student, a university employee, or the University Police Department notifies OSRR of an incident that may constitute sexual misconduct, the office will initiate an investigation by contacting the survivor and explaining the process and goals of the investigation.  While investigations of all reported incidents are required, the survivor may decline to provide information at any point during this process.  The survivor is entitled to have an advisor or support person present in any meetings throughout this process.

Based on the facts provided by the survivor, the alleged perpetrator, and the University Police Department, OSRR will make necessary contacts with the people involved to determine the details and circumstances surrounding the incident.  The OSRR Coordinator will then meet with the survivor to explain whether or not there is sufficient information, a preponderance of the evidence, to file a charge.

If a student is charged, the student will meet with the OSRR Coordinator to determine if a settlement can be reached.  Sanctions could include a stay away order, reasonable modifications of class schedules and other on-campus activities, counseling to address alcohol/drug use or impulse control, disciplinary probation, suspension, or expulsion.  If no settlement agreement is reached, a formal hearing will be held in accordance with the provisions of Executive Order 970.  Although the hearing can be arranged to avoid direct visual contact with the charged student, the survivor is asked to provide information either verbally or in writing.

A survivor should not consider the Standards for Student Conduct governing alcohol and drug use a barrier in reporting an incident of sexual misconduct.  The survivor will be notified of the result of any settlement conference or hearing occurring as a result of the investigation.
