Sexual Misconduct
Sexual misconduct involves non-consensual sexual behavior committed by a student against a member of the Cal Poly community. Sexual misconduct includes date rape, sexual assault, and harassment. If a member of the Cal Poly community is subjected to sexual misconduct by a Cal Poly student, the Office of Student Rights & Responsibilities (OSRR) can take steps to promote safety and to impose appropriate consequences. The Standards for Student Conduct prohibit “conduct that threatens or endangers the health or safety of any person within or related to the University community, including…sexual misconduct.

What constitutes “consent”?
Consent requires clear communication between the individuals involved. Individuals who are intoxicated, under the influence of a controlled substance, or underage are unable to give proper consent. The use of force, pressure, or manipulation does not amount to knowing and willing consent.
It is important to remember: the absence of “no” ≠ “yes.”
