Frequently Asked Questions

Is the Cal Poly student disciplinary process similar to those of other colleges?
The student disciplinary process is the same at all 23 California State Universities (Humboldt to San Diego State) and is authorized according to Section 41301, Title V, California Code of Regulations. Almost all colleges and universities have a student disciplinary process.

How does the Office of Student Rights & Responsibilities decide to contact me?
A complaint or allegation of a violation of University rules and regulations is received by OSRR, usually in the form of a University Police Dept. report, a Housing referral or a notice from faculty. OSRR investigates the allegation and if there is evidence of a violation, initiates the student disciplinary process by sending the student a letter containing a notice of the charges and directing the student to call the Office of Student Rights & Responsibilities to schedule an appointment.

Can I consult an advisor, including an attorney, during the disciplinary process?
A student may confer with family members, advisors or attorneys at any stage in the informal or formal process but attorneys are not permitted to participate in a hearing if the matter proceeds to that phase.  If a student intends to bring an attorney to any meetings with the Coordinator, the student must provide the attorney’s name to OSRR at least three days prior to the meeting.

What happens at the first meeting?
The first meeting is an informal meeting between the OSRR Coordinator and the student charged. It is a chance for the Coordinator to explain the disciplinary process to the student and the student’s rights within that process. The Coordinator also shares with the student the information contained in the complaint filed against them. The student then has an opportunity to respond to the information and provide any information that he or she feels is important. This meeting is an opportunity for the Coordinator and the student charged to have an open and honest discussion about the incident. Usually, as a result of this meeting, the student and the Coordinator agree on a mutually acceptable resolution to the incident.

Does OSRR have off-campus jurisdiction?
"Conduct that threatens the safety or security of the campus community, or substantially disrupts the functions or operation of the University is within the jurisdiction of this Article regardless of whether it occurs on or off campus" [Title 5, Article 2, Sec. 41301 (d)].
